DEPOSIT

A 50% deposit is required with all bookings to secure our time together and by paying this deposit, the client agrees to all terms and conditions listed here and/or on the contract. This deposit is non-refundable and non-transferable in the event of cancellation by the client. The deposit will be deducted from the cost of the client’s chosen package when calculating the final balance due. Payment in full of the remaining balance will be due by the session date at the latest.

SESSION CANCELLATION

The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than 2 weeks before the session will result in the payment in full becoming due. All cancellations must be in writing.

RAW IMAGES

I do not send RAW/original/unedited files to clients. All images are post-processed and delivered in high resolution JPEG through a digital e-gallery. 

DISPLAY

The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.

EXECUTION

Digitally signing the contract has the same effect as manually signing a paper original.

IMAGES

All final images are determined by the photographer. Images cannot be altered in any way without express permission of the photographer - for example, no added Instagram filters. The Photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. The photographer's movements are sometimes restricted by the official in charge or venue rules. The client agrees to accept these potential obstructions of view.

RETOUCHING

All images will be professionally edited with the Photographer's judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. The basic retouching included in all packages is to rid of distractions (i.e. hair in the eye, slight skin smoothing, pimples). Anything that is not considered distracted will not be included in the basic retouching. Client can purchase additional retouching per photo at $35 each. Lastly, the clients agree to not edit, retouch, enhance or add filters to the images provided by the photographer for any purpose.

COPYRIGHT

The copyright Designs and Patents Acts assign the copyright of the images to the Photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing.

ADDITIONAL PERMITS

If the client’s location for the pre-wedding location requires any permits or fees, the client will bear those additional costs and ensure these are purchased in advance. Click Away Photography shall not be held responsible if unable to perform services at the time of the pre-wedding shoot. In the case where this does occur, the client will forfeit their pre-wedding shoot and will not have another opportunity to include the requested coverage related to pre-wedding shoots.

INDEMNIFICATION

Client hereby agrees to indemnify, release, discharge and hold harmless the Photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority of the Photographer from and against any liability or claims arising as a result of any work done related to this agreement. This includes, but is not limited to claims related to the use of the likenesses of anyone captured in the images or any distortion, blurring or alteration that may occur or be produced in the taking, processing or reproduction of the photographs.

ACT OF GOD

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

ATTENDANCE

In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.

LIMITATION OF LIABILITY

Although all care will be taken with these photography services and the digital photographs taken, the Photographer limits any liability for loss, injury, death, inability to perform the photography services for any reason, failure to deliver images for any reason or any other types of damages to the return of all payments already paid to the Photographer up to Total Amount defined above.

PERSONAL ACCIDENT

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said person’s own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

WEDDING ARRANGEMENTS

The details of the wedding arrangements such as schedule of events and shot list are to be agreed beforehand in writing (email is acceptable) at least 2 weeks prior to the wedding. The Client shall notify the Photographer of any changes to these details in writing. The Photographer/s cannot be held liable for delays or disruption in their delivery of the service until any changes are received, and acknowledged in writing.

WEDDING CANCELLATION

The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing.

LICENCE

The Photographer/s shall be granted artistic license in relation to the poses photographed and the locations used. The Photographer’s judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested

DATA STORAGE AND ACCESS

Click Away Photography will store and maintain the raw and the edited data of the photographs and video up to 7 days from the delivery of the edited product and reserves the right to wipe off all the raw data and the edited data on the 8th day after the final edited product has been delivered to the client without any notice to the client. The client also agrees that Click Away Photography reserve the right to not grant access to raw and unedited photographs and video footage.

REWORK ON THE EDITED AND DELIVERED PRODUCT AND SCOPE OF CHANGES

The client agrees that once the entire edited product is delivered to the client they have 7 days from the delivery of the edited product to request changes after which Click Away Photography will not be able to rework any portion(s) of the already delivered product. In case changes are requested for the delivered videos the client agrees that they will get only one opportunity to request changes within the 7 days from the delivery of the edited videos and no further changes will be accepted by Click Away Photography. The client also accepts that the changes requested will only include changes to the background songs and deletion of scenes from the edited video and no new footage will be added to the already delivered edited videos.

MEALS

The client agrees to provide the Photographer/s meals for weddings longer than 6 hours.
